Processes and Purposes of Receivers Appointments

Receivers are appointed by the court as a neutral fiduciary during pre- or post-judgment proceedings, and may be related to Civil, Probate, Real Estate, Class Action or Regulatory actions, at a state or federal level. Their responsibility is to control assets, businesses and other real properties involved in litigation in order to preserve them during the pending outcome of said litigation.

The appointment of this neutral receiver is not a specific cause of action, but rather a provisional remedy provided for by the power of the state or federal court. California particularly has several statutes which provide for this appointment in the event of specific types of litigation against a part or entity.

Specific court language refers to a receiver as the “hands and eyes” of the court, thereby carrying out any necessary actions to preserve the assets of the receivership estate.

It is important to remember that a receiver is not a representative or agent for the party owning these assets or plaintiff; rather, a receiver is granted powers as an officer of the court to benefit all parties involved in the litigation.

Receivers are typically required to hold and manage the businesses and assets in question, or sell the assets for liquidation purposes to produce cash.

Placing these real properties, businesses and other assets that are the subject of the litigation at hand into the control of a receiver allows for all parties involved to remain confident they are being managed and preserved properly.

Courts may ask the receiver, as a neutral fiduciary, to research past accounting records to verify where any funds were placed and by whom.

They may also be required to discover and search for hidden assets or conduct general discovery for the court.

Due to the fact that the court has granted certain powers to the receiver, any refusals to provide records requested to find this information for the court could result in contempt proceedings against the refusing party.

Receivers are paid with the estate in question’s assets, which also relieves a party to the litigation from funding this cost alone. Appointing a receiver is financially advantageous to the court as well, as any requests given the receiver could avoid unnecessary and numerous court appearances by the parties to the litigation.

By reducing the amount of research and cost necessary to discover these items alone, a court appointed receiver reduces cash outlay and angst during the related proceedings for all parties involved.

Question by mike: My Onkyo receiver says that zone 2 needs a password?
The speakers are hooked up outside. Every time I try to raise the volume it says I need password not activated. Anyone know the password or whats wrong?

Hmm…I also have an Onkyo w/ Zone 2, but mine doesn’t need a password for volume.

Did it need a password ever since you bought it? If that’s the case, look through the manual to see how to disable the password.

If it just recently came up, you just might’ve been hitting the wrong button, or you accidently hit a password button.

Just try searching on their website Faq, or go through the manual.

Hope you get it fixed!

P.S. Onkyo’s are pretty cool with there zone 2 features…I always use mine when I’m swimming out back.

Is HDMI upscaling necessary for home cinema when I have a ps3?

Question by : Is HDMI upscaling necessary for home cinema when I have a ps3?
Is this a feature I can completely ignore in the buying process? because I only want the system to run from my ps3 and I’m pretty sure that they already upscale dvd quality?

Answer by Grumpy Mac
You are correct. Having the DVD/BluRay player do the up-conversion is the better way to go and you dont need this feature in the receiver.

HOWEVER: Might you ever connect up a Wii or a standard def Cable/Sat box to the system? If so – it’s not a bad feature to have.

Majority of them home theater in a box does not offer you any inputs. They are mainly designed for you to watch a dvd or blu ray disc movies with surround sound. Look and see if the system has an optical audio input or an rca. Optical will provide you a surround sound while the rca only in stereo. If you do not have one, then you are not going to be able to do this at all. If it has, then you connect the PS3 directly to the tv using HDMI cable and then connect an optical audio cable from the tv to the surround system. Hope this will help you out.

what do I need to connect my Home theater system to my vista media center PC?

Question by been there: what do I need to connect my Home theater system to my vista media center PC?
I just bought a VIsta Premium PC and I want to connect it to my HD Home theater system. I want to not only view pictures and listen to music but also record TV shows from Direct TV. The PC has VIsta Home Premium and comes with a TV tuner card and wireless lan. I know you can do the cable thing but my PC and TV are in two different rooms and all these cables for satelite, video and audio would be a nightmare.

What are my options?

The best thing you could do is have someone come over and do it for you. Otherwise you will have to tell someone exactly what you have for equipment and how far everything is apart so they can tell you what to do.

How do I connect a vibration motor to a home theater system?

Question by : How do I connect a vibration motor to a home theater system?
I found a couple vibration motors and I want to put in my furniture in sync with my home theater system. Like a game controller vibrates when you get hurt I want to have them shake with my subwoofers. How do I do this? I don’t know they plug in, I haven’t bought them. I was looking at the Dayton 5FTT3 motor if that helps.

Can’t find that model on the PE web site, edit with the PE part#.

These basically work a lot like speakers, they need an amplifier. I really can’t recommend them in general.

You really need some heavy duty linear motors in an X:Y:Z axis to do this right. http://www.aerotech.com/products/motors/blm.html Unfortunately this isn’t really a viable option unless you plan to sink a ton of money into it. It would be cool though, your chairs would need seat belts!

As for the typical “Bass Shakers” however these just can’t get low enough in frequency to do any good, they vibrate the chair, they don’t shake the chair. They’re just plain annoying! You will be better off building some massive subs that can get well below 20 Hz and then you won’t need or want shakers in the chairs.
